1. Acceptance of Terms

By accessing or using the Family Legacy Gifts service (“Service”) at familylegacygifts.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Family Legacy Gifts, a Texas-based single-member LLC.

2. Description of Service

Family Legacy Gifts provides a software-as-a-service (SaaS) platform that enables families to organize, document, and plan the distribution of personal property and heirlooms, preserve family memories, and manage estate-related planning. The Service is not a legal, financial, or estate planning service and does not constitute legal advice.

3. Accounts and Registration

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate and current information during registration.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

4.1 Paid Plans

Access to certain features requires a paid subscription. Pricing and plan details are available on our website. All fees are in U.S. dollars.

4.2 Billing

Subscriptions are billed on a recurring basis (monthly or annually, as selected). Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.3 Taxes

You are responsible for all applicable taxes. Texas sales tax may apply to your subscription as required by law.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by law.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe upon the intellectual property rights of others
  • Upload or transmit malicious code, viruses, or harmful content
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service for any commercial purpose other than as intended
  • Circumvent or disable any security or access control features

6. User Content

6.1 Ownership

You retain full ownership of all content you upload to the Service, including photos, text, and documents (“User Content”).

6.2 License to Us

By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your content solely for the purpose of providing the Service to you.

6.3 Your Responsibility

You are solely responsible for your User Content. You represent that you have all rights necessary to upload and use such content, and that it does not violate any third-party rights or applicable laws.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Family Legacy Gifts and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Family Legacy Gifts and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Family Legacy Gifts and its officers, employees, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service will immediately cease. You may request an export of your data prior to termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Collin County, Texas. You consent to personal jurisdiction in those courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions will remain in full force.
  • Waiver: Our failure to enforce any right or provision is not a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our written consent.
